These Terms and Conditions govern the use of the Outboard Tuning website, the purchase of tuning products and services, and use of any tuning files, calibration services, technical information, or related products supplied by Outboard Tuning.
By purchasing, accessing, downloading, installing, or using any Outboard Tuning product or service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
1. ECU TUNING & PERFORMANCE MODIFICATIONS
Outboard Tuning provides ECU calibration and performance tuning services intended to modify the operating characteristics of compatible marine outboard engines.
Depending on the engine platform and calibration, tuning may modify parameters including, but not
limited to:
• Fuel delivery
• Ignition timing
• Throttle control
• Torque management
• RPM limitations
• Speed limitations
• Engine operating parameters
• Other ECU controlled functions
Performance results vary depending on engine condition, hardware configuration, fuel quality, propeller selection, hull configuration, operating conditions, and other factors.
Horsepower, torque, speed, acceleration, fuel economy, and other performance improvements are not guaranteed unless specifically stated for a particular product or application.
2. FACTORY WARRANTY DISCLAIMER
ECU TUNING MAY AFFECT YOUR FACTORY WARRANTY
Installing or using an aftermarket ECU calibration tool may void, limit, or affect the manufacturer's warranty on your outboard engine or related components.
Factory warranties are controlled by the original equipment manufacturer and not by Outboard Tuning. We make no representation that an ECU tune will be accepted under a manufacturer's warranty program.
Before purchasing or installing a tune, customers are responsible for determining how ECU modifications may affect their specific manufacturer's warranty.
Outboard Tuning is not responsible for:
• Warranty denial
• Loss of warranty coverage
• Reduced warranty coverage
• Warranty claims rejected by the manufacturer
• Diagnostic charges resulting from a modified ECU
• Costs associated with returning an engine to factory calibration
• Any consequential costs resulting from warranty restrictions
If maintaining your factory warranty is a priority, consult the engine manufacturer or authorized dealer before installing an aftermarket ECU calibration.
3. ENGINE CONDITION
Outboard Tuning assumes that the engine being tuned is mechanically sound and suitable for the requested calibration. An ECU tune cannot correct underlying mechanical problems.
Customers are responsible for ensuring that their engine is properly maintained and free from known mechanical, electrical, fuel, cooling, lubrication, or ignition problems before tuning.
Outboard Tuning is not responsible for failures caused by:
• Pre-existing mechanical conditions
• Excessive engine wear
• Improper maintenance
• Defective components
• Previous modifications
• Incorrect installation
• Fuel contamination or improper fuel
• Cooling system problems
• Lubrication problems
• Electrical faults
• Overheating
• Improper operation
Customers should address known mechanical issues before installing a performance calibration.
4. PERFORMANCE MODIFICATION RISKS
Performance tuning can increase engine output and change the operating characteristics of an outboard engine.
Increased power and torque can place additional loads on:
• Engine components
• Gearcases
• Propellers
• Driveshafts
• Cooling systems
• Fuel systems
• Electrical systems
• Mounting components
• Steering systems
• Other drivetrain and marine components
Performance modifications may also increase operating speed and alter the handling characteristics
of a boat.
The customer assumes responsibility for determining whether their boat, engine, drivetrain, steering system, propeller, and other components are suitable for the modified performance level.
Outboard Tuning does not guarantee that factory components will tolerate increased power under all operating conditions.
5. CUSTOMER INFORMATION & VEHICLE / ENGINE DATA
Accurate information is required to provide the appropriate calibration.
Customers are responsible for providing accurate information regarding their:
• Engine make and model
• Model year
• ECU configuration
• Engine serial number
• Existing modifications
• Intake and exhaust configuration
• Propeller
• Fuel type
• Intended application
• Operating conditions
• Other relevant modifications
Incorrect or incomplete information can result in an inappropriate calibration.
Outboard Tuning is not responsible for problems resulting from incorrect, incomplete, or misleading information supplied by the customer.
6. ECU INSTALLATION & FLASHING
Unless specifically stated otherwise, the customer is responsible for following all supplied instructions when installing, flashing, or applying an ECU calibration.
Customers must ensure that:
• The correct ECU is being programmed
• The battery has sufficient voltage
• Electrical connections are secure
• The appropriate programming equipment is used
• The engine remains stationary and secure during programming
• Programming instructions are followed correctly
Interrupting an ECU programming procedure, disconnecting power, using incompatible equipment, or otherwise interfering with the programming process may result in ECU communication or programming issues.
Outboard Tuning is not responsible for damage caused by improper installation, incorrect equipment, interrupted programming, electrical problems, or failure to follow supplied instructions.
7. REMOTE & DIGITAL SERVICES
Certain Outboard Tuning products or services may be delivered digitally, including ECU calibration files, programming instructions, software, technical information, or other electronic content.
Digital products are considered delivered when they are made available to the customer through the applicable delivery method.
Customers are responsible for maintaining appropriate equipment, internet connectivity, electrical power, and compatible hardware required to use the product or service.
8. PERFORMANCE RESULTS
Performance results can vary significantly between engines and applications.
Factors affecting performance may include:
• Engine condition
• Engine configuration
• Fuel quality
• Fuel octane
• Ambient temperature
• Air pressure
• Water temperature
• Propeller selection
• Hull design
• Boat weight
• Engine height
• Gear ratio
• Intake and exhaust configuration
• ECU version
• Engine manufacturing tolerances
• Operating conditions
Published horsepower or performance figures should be considered representative rather than guaranteed results unless expressly stated otherwise.
9. MARINE SAFETY
Marine performance modifications can increase vehicle speed and change handling characteristics.
Customers are responsible for operating their boat safely and within applicable laws, regulations, manufacturer recommendations, and personal limitations.
Always use appropriate safety equipment and follow applicable boating regulations.
Never operate a modified watercraft at speeds or under conditions beyond the capabilities of the hull, steering system, propulsion system, or operator.
Outboard Tuning is not a substitute for safe boating practices, professional mechanical inspection, or proper marine training.
10. EMERGENCY & SAFETY ISSUES
Outboard Tuning is not an emergency marine service, rescue service, towing service, or emergency mechanical response service.
If an engine or boat develops a potentially dangerous condition, stop operation and address the safety issue before continuing. Examples include:
• Fuel leaks
• Fire
• Rapid overheating
• Electrical arcing
• Loss of steering
• Severe engine malfunction
• Water intrusion
• Sinking
• Structural failure
Do not continue operating a boat or engine when doing so could create a risk of injury, property damage, or environmental damage.
11. TECHNICAL SUPPORT
Technical support is provided based on the information available to Outboard Tuning at the time of diagnosis or consultation.
Support may rely on information supplied by the customer, including photographs, videos, ECU information, diagnostic information, engine specifications, and descriptions of the issue.
Outboard Tuning cannot guarantee that a remote diagnosis will identify every underlying problem.
Additional mechanical or electrical issues may exist that cannot be identified without physical inspection.
Recommendations are provided based on the information available and the professional judgment of Outboard Tuning.
12. PARTS & THIRD PARTY PRODUCTS
Outboard Tuning may recommend or work with aftermarket components manufactured by third parties.
Outboard Tuning does not control the manufacturing, availability, shipping, quality, or warranty policies of third-party products.
Third-party products are subject to the manufacturer's applicable terms and warranty.
Customers are responsible for confirming compatibility before installing aftermarket components.
13. USE OF PERFORMANCE CALIBRATIONS
Outboard Tuning calibrations are intended for compatible marine applications and must be used only for their intended purpose.
Customers must not:
• Modify or alter supplied calibration files without authorization
• Resell or redistribute calibration files
• Share calibration files with third parties
• Reverse engineer proprietary calibration files
• Remove proprietary identifiers or protections
• Use a calibration on an incompatible engine or ECU
Unauthorized distribution or modification of Outboard Tuning intellectual property may result in termination of service and other remedies available under applicable law.
14. EMISSIONS & LEGAL COMPLIANCE
Customers are responsible for ensuring that any modifications made to their engine comply with applicable federal, provincial, state, municipal, marine, environmental, emissions, and other laws and regulations.
Outboard Tuning does not authorize customers to use its products or services for unlawful purposes.
Customers are responsible for determining whether a particular modification is legal for their intended application and jurisdiction.
15. LIABILITY DISCLAIMER
To the maximum extent permitted by applicable law, Outboard Tuning, its owners, employees, contractors, technicians, affiliates, and service providers are not responsible for losses, damages, or injuries arising from the use or misuse of its products or services.
This includes, but is not limited to:
• Engine damage
• ECU damage
• Gearcase damage
• Propeller damage
• Drivetrain failure
• Electrical damage
• Fuel system damage
• Cooling system failure
• Fire
• Overheating
• Loss of performance
• Loss of use
• Property damage
• Boat damage
• Warranty denial
• Personal injury
• Death
• Consequential or incidental damages
Nothing in these Terms and Conditions is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
16. CUSTOMER RESPONSIBILITY
By purchasing or using an Outboard Tuning product or service, the customer acknowledges that performance tuning involves inherent mechanical and operational risks.
The customer is responsible for:
• Confirming engine compatibility
• Providing accurate engine information
• Ensuring the engine is mechanically sound
• Using appropriate fuel
• Following installation instructions
• Maintaining the engine properly
• Confirming hardware compatibility
• Operating the boat safely
• Complying with applicable laws and regulations
17. RETURNS & REFUNDS
Due to the customized and digital nature of ECU tuning services, refunds may be subject to the specific product or service purchased.
Once a customized calibration has been developed, supplied, or delivered, the service may not be eligible for cancellation or refund.
Where a physical product is supplied, returns are subject to the applicable product-specific return policy.
Outboard Tuning reserves the right to refuse a refund where:
• A calibration has already been delivered
• A customized service has already been performed
• The customer supplied incorrect information
• The product has been improperly installed or used
• The customer has modified or damaged the product
• The issue is caused by an unrelated mechanical problem
Any applicable consumer rights provided by law remain unaffected.
18. INTELLECTUAL PROPERTY
All Outboard Tuning calibration files, software, technical documentation, website content, graphics, logos, written materials, and other proprietary materials remain the property of Outboard Tuning or their respective owners.
Purchasing a tuning service does not transfer ownership of the underlying calibration technology or intellectual property.
Customers receive a limited right to use the supplied calibration for the intended application only.
19. RIGHT TO REFUSE SERVICE
Outboard Tuning reserves the right to refuse or discontinue service where a request:
• Presents an unreasonable safety risk
• Involves unlawful activity
• Involves fraudulent warranty claims
• Involves unauthorized use or distribution of calibration files
• Involves abusive or threatening conduct
• Involves an incompatible or unsafe application
• Otherwise conflicts with these Terms and Conditions
20. CHANGES TO THESE TERMS
Outboard Tuning may update these Terms and Conditions when deemed necessary.
The current version published on this website will govern use of the website and applicable products and services.
Customers are encouraged to review these Terms and Conditions before purchasing additional products or services.
21. GOVERNING LAW
These Terms and Conditions are governed by the applicable laws of the jurisdiction in which Outboard Tuning operates, without regard to conflict of law principles.
Any disputes will be subject to the applicable courts and legal jurisdiction determined under those laws.
22. ACCEPTANCE OF TERMS
By purchasing, installing, accessing, or using an Outboard Tuning product or service, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them.
